Notice of intent

Updated:

Definition

The Federal Register document DEA publishes before a temporary scheduling order, stating which substances it intends to control and giving at least 30 days before an order can issue. The 7-OH notices of 2026-07-06 (91 FR 40917) and 2026-10-14 (91 FR 65370) are notices of intent; neither is itself an order.

A notice of intent announces what DEA means to do; it changes nothing on its own. The July 2026 notice proposed control of 7-hydroxymitragynine above 0.050 percent or 1.00 mg per article and said no order would issue before 2026-08-05 (91 FR 40917). It was withdrawn and replaced by the October 2026 notice, which sets the thresholds at 1 mg per gram or milliliter and a 100-to-1 mitragynine ratio and says an order may publish on or after 2026-11-13 (91 FR 65370).

The distinction matters for this store's watcher. A Federal Register document of type notice or proposed rule creates an alert for review; only a document of type rule with an effective date schedules a removal. The October notice is seeded into the watcher as its first alert.
