When does the Kentucky kratom ban take effect?
Written by: Author pendingReviewed by: Reviewer pendingUpdated:
On 2027-07-01. HB 757 (2026 Acts ch. 161 § 114) enacted a statewide sales ban, and HB 869 moved the date from 2027-01-01 to 2027-07-01; until then Kentucky's 2024 consumer-protection act and a 400 ppm 7-OH rule apply (Recording Law, Kentucky).
What governs Kentucky until then?
KRS 217.2201 to 217.2209, the 2024 consumer-protection act, sets 21+ and a 2 percent cap on 7-hydroxymitragynine as a share of alkaloids. A regulation effective 2026-03-12, 902 KAR 55:015, makes 7-OH above 0.4 mg per gram (400 ppm) on a dry-weight basis a state Schedule I substance, the tightest per-gram line in the country (Recording Law, Kentucky). The act's label section, KRS 217.2203, was repealed effective 2026-07-15 ahead of the ban.
Why do some sources say January?
A television report gave 2027-01-01 as the date; the statute history shows HB 869 (ch. 198) moved it to 2027-07-01. The research notes the conflict and follows the statute (Kentucky Lantern). One seller's published list ends Kentucky shipping on 2026-12-31, a conservative reading of the same conflict.
Could the ban be blocked?
A manufacturer filed suit in June 2026 claiming the bill is unconstitutional (WKYT). The research found no ruling. If a court stays the ban, the store's table is edited and the change is logged on the legality hub.
How does this store handle the date?
The Kentucky rows carry a "gate" status with an end date of 2027-06-30 and an "exclude" status with a start date of 2027-07-01. The change applies automatically; no one has to remember it. The mechanism is described on the state policy page.
