Is kratom legal in my state?
Written by: Author pendingReviewed by: Reviewer pendingUpdated:
In 33 states and nothing else, as of 2026-10-20. Ten states ban it by statute or rule, California by enforcement, North Dakota by executive order, and Rhode Island and Utah allow only in-state licensed retail; nineteen states regulate it under consumer-protection acts (91 FR 65370).
Which states ban kratom outright?
DEA's October 2026 notice lists ten: Alabama, Arkansas, Connecticut, Indiana, Kansas, Louisiana, Massachusetts, Tennessee, Vermont and Wisconsin (91 FR 65370). Five of those are recent: Louisiana from 2025-08-01, Connecticut from 2026-03-25, Kansas and Tennessee from 2026-07-01, and Massachusetts by emergency regulation from 2026-08-28.
Which states are closed some other way?
California's health department has told licensees that selling kratom "in any form for consumption" is not permitted and that products may be embargoed and seized (CDPH letter). North Dakota banned sales by executive order on 2026-08-05 pending a licensing scheme that is not yet operating. Rhode Island permits sales only through dealers licensed by its health department (RIDOH), and Utah permits only pure leaf through registered tobacco specialty retailers. Ohio permits leaf but not extract.
Which states regulate rather than ban?
Nineteen states have consumer-protection statutes per DEA, with Delaware, Minnesota and Wyoming added in 2026. They set alkaloid caps, label content and an age, 21 in most of them and 18 in Arizona, Illinois, Nevada, Oklahoma and Texas. The remaining states have no kratom statute. The full table with every citation, the local city and county layer, and the date each row was reviewed is the legality hub; the long version is kratom law by state.
Does this store ship wherever it is legal?
No. It also excludes the District of Columbia as a precaution and Maryland because of a label rule that a not-detected 7-hydroxymitragynine result cannot satisfy. See which states this store does not ship kratom to.
