Why does Ohio allow kratom leaf but not extract?

Written by: Author pendingReviewed by: Reviewer pendingUpdated:

Answer

Ohio's Board of Pharmacy rule, permanent since May 2026, places mitragynine-related compounds in Schedule I "in the resinous extractives of mitragyna speciosa" while excluding "kratom in its natural, vegetative form," so leaf ships and extracts do not (Ohio Board of Pharmacy).

What does the Ohio rule say?

Answer

Ohio Administrative Code 4729:9-1-01.1 began as an emergency rule on 2025-12-12 and was approved as a permanent rule on 2026-04-13, effective in May 2026. It places four mitragynine-related compounds in Schedule I, including those found "in the resinous extractives of mitragyna speciosa," and excludes "kratom in its natural, vegetative form" (Ohio Board of Pharmacy). News reports give the effective date as 2026-05-14 or 2026-05-19 (Hoodline).

How does this store apply it?

Answer

Its state table carries separate rows for kratom extract and kratom leaf. The Ohio extract row is "exclude"; the leaf row is "ship." Tablets, shots and tinctures made from extract are blocked at checkout for an Ohio address and the state is named. Sellers that publish Ohio rules do the same: one ships crushed leaf only.

Is Utah the same?

Answer

Similar in substance, different in reach. Utah's 2026 statute bans "any kratom product that is not 'pure leaf kratom'" and limits even leaf to registered Retail Tobacco Specialty Businesses in Utah (Utah Attorney General), so an out-of-state online seller cannot ship either format there. Utah is excluded for both classes.

Why does the format matter so much?

Answer

Because extraction concentrates the alkaloids. A pressed leaf tablet holds about 3 mg of mitragynine; an extract tablet on this store's lab-results pages holds 57 to 70 mg. See leaf versus extract.
